Welcome to Avius. We’ve drafted these Terms of Service, so you’ll know the rules that govern our relationship with you. Thank you for taking the time to read it.
The terms (“us,” “we,” the “Company” or “Avius”) refer to Avius Tech Private Limited, a company based in India.
1. Acceptance of Terms of Service agreement:
By creating an Avius account you agree to be bound by these Terms of Service, and any terms of services disclosed and agreed to by you if you purchase services we offer. If you do not accept and agree to be bound by all of the terms of services of this Agreement, please do not use the Service. We may make updates & changes to this Agreement and the Service accordingly. We may do this for a variety of reasons including to reflect changes in or requirements of the law, new features, security, or changes in business practices.
2. Who can use the service:
You must be at least 18 years of age to create an account on Avius and use the Service. By creating an account and using the Service, you represent and warrant that you have never been convicted of a felony or indictable offense (or crime of similar severity), a sex crime, or any crime involving violence. You will comply with these Terms and all applicable local, state, national and international laws, rules, and regulations. If you are using the Services on behalf of a business or some other entity, you state that you are authorized to grant all licenses set out in these Terms and to agree to these Terms on behalf of the business or entity.
3. Your account:
You are responsible for maintaining the confidentiality of the login methods you use to sign up for Avius, and you are solely responsible for all activities that occur under those methods. If you think someone has gained access to your account, please immediately contact us. You are also responsible for safeguarding your account, so use strong methods and limit its use to this account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above.
You are responsible for your use of the Services and for any Content you provide, including compliance with applicable laws, rules, and regulations. You should only provide Content that you are comfortable sharing with others.
4. User account name, user atag terms:
Atags can be alphanumeric additionally consecutive use of hyphen & dot is not allowed. Atags can only be changed once in 30 days.
Atags, account name containing the word Avius in it & other words which Avius doesn’t allow cannot be claimed. No account names or atags can contain the word Avius unless they are official Avius accounts.
Atags of an inactive account or groupcards are available to register whenever that inactive account gets automatically deleted by the system. Carrying out any kind of business or financial transaction for the transfer of atags is not allowed on the Avius Ecosystem, if any such information is found, all accounts or emails connected with such businesses will be terminated also will be banned from using the service permanently without notice.
Your atag, account name can not contain an abusive word or a name in it which hurts the sentiments of any individual, group, or community globally.
Atags shown on Avius map that contains a word or are related to God, Religion, Caste, Race & also words in the name of an individual, group, or community who have carried out an inhumane act in the history of mankind are strictly not allowed on Avius Ecosystem. If any such information is found, those accounts & emails are not entertained & will be terminated also will be banned from using the service permanently without notice.
If your atag is requested by a renowned business organization, web, crypto or nft domain owner, also if it contains an offensive word then Avius holds the right to change or remove it without notice.
Avius hold the power & right to change your atag at any moment without notifying you. If you notice a change in your atag, Avius suggests you not to claim the previous atag again & keep the current atag which is changed by Avius or choose one which is accepted by Avius Ecosystem. If you, again and again, claim a atag that is not allowed by the Avius system then your account is terminated and also will be banned from using the service permanently without notice.
Avius accounts should be created only by yourself with complete responsibility. Avius may ask you for proof of ownership or may submit user account data to law authorities as and when required without notice. Users are responsible person of user accounts created by themselves, if a user gets banned by the system then that user may lose their account and account data completely, eventually losing any in-app purchases made by them.
5. Groupcard, groupcard name, groupcard atag terms:

Groupcards should be created only if you are the owner or responsible person of the property and businesses, company or entity to organise an event to be shown on Avius Maps. Choosing a wrong groupcard category or misleading users on the map will lead to groupcard removal & permanent ban to all group admin accounts without notice. Private groups, communities, religious or political organisations & places are strictly not allowed on Avius maps. Avius may ask you for proof of ownership or may submit Groupcard data to law authorities as and when required without notice. Admins are the responsible person of respective groups or groupcard, every admin has equal powers & if a admin or all admins get banned by the system then that admin or admins of the group may lose complete access to groupcard or groupcards created by them eventually losing any in-app purchases made by them.
6. Location snapshots terms:
We take user safety concerns very seriously. We store your last 20 locations in our database to address these concerns. This information may be provided to law enforcement authorities if required by a government request or a court order.
We collect this data to prevent scammers and individuals with ill intentions from using our service. We inform you transparently, unlike other businesses. If you do not wish for us to save your location snapshots, we recommend that you delete your Avius account.
7. Updating the Service & Termination:
Avius may add new product features or enhancements accordingly as well as remove some features. We hold the right to suspend the Service entirely, in which event we will notify you in advance unless extenuating circumstances, such as safety or security concerns, prevent us from doing so.
Avius may perform cron jobs every minute, an hour, or every day to delete data that has expired like chats, images, videos, posts which are known as queeks, any data created by the user or the system & also inactive accounts or groupcards without notifying the users of the service.
You may terminate your account or delete groupcards created by yourself for any reason, by following the instructions provided in “Settings” in the Service. Also, Avius may terminate your account or remove groupcard at any time without notice if it believes that you have violated this Agreement. Upon such termination, you will not be entitled to any refund for purchases. Avius also holds the power to terminate your account & delete groupcards or groups linked to your account if it has no activity for a specified or a very long period, this process is carried out to free atags of dormant accounts or groupcards, remove pins or markers from the Avius maps, old data or remove fake accounts, as a result, such accounts lose all the data related.
8. Know your rights:
You retain your rights to any Content you submit, post, or display on or through the Services. What’s yours is yours - you own your Content (and your incorporated audio, photos, and videos are considered part of the Content). Avius grants you a personal, worldwide, royalty-free, non-assignable, non-exclusive, revocable, and non-sublicensable license to access and use the Service. You agree :
Not to use the Service or any content contained in the Service for any commercial purposes or make use of, or reproduce in any way or use any copyrighted material, images, trademarks, trade names, service marks, or other intellectual property, content, or proprietary information accessible through the Service without Avius’s prior written consent.
You will not use the Services in a way that could interfere with, disrupt, affect negatively or inhibit other users from fully enjoying the Services or that could damage, disable, overburden or impair the functioning of the Services. You will not use methods like hacking or upload viruses or other malicious code or otherwise compromise the security of the Service.
You may not copy, modify, distribute, sell or lease any part of our Services. Nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit these restrictions or you have our written permission to do so.
The Company may investigate and take any available legal action in response to illegal or unauthorized uses of the Service, including termination of your account.
9. Rights you grant Avius:
By creating an account, you grant to Avius a worldwide, royalty-free, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, edit, publish and distribute that content for as long as you use the Services. Public Content is public by nature also Avius would have an exclusive license to screenshots or screen records of the Service that include your Content.
You agree that all information that you submit upon creation of your account, is accurate and truthful and you have the right to post the Content on the Service and grant the license to Avius above. We reserve the right to delete any content which we think violates these Terms of Service, or if necessary to comply with our legal obligations, or damages the image of the company. However, you alone remain responsible for the content you create, upload, post, send or store through the Services.
When communicating with our respective directors, officers, agents, employees, customer care representatives, you agree to be respectful and kind. If we feel that your behavior towards any of our respective directors, officers, agents, employees, customer care representatives is at any time threatening or offensive, we reserve the right to immediately terminate your account.
In consideration for Avius allowing you to use the Service, you agree that we may place advertising on the Service. By submitting suggestions or feedback to Avius regarding our Services, you agree that Avius may use and share such feedback for any purpose without compensating you.
Please be informed that Avius may access, store and disclose your account information and content if required to do so by law, by performing its agreement with you, or in a good faith belief that such access, storage, or disclosure satisfies a legitimate interest, including to comply with legal process, enforce the Agreement, respond to claims that any Content violates the rights of third parties, respond to your requests for customer service or protect the rights, property or personal safety of the Company or any other person.
10. Safety:
Avius is not responsible for the conduct of any user on or off of the Service. You agree to use caution in all interactions with other users, particularly if you decide to communicate off the Service or meet in person. Avius does not conduct criminal background checks on its users or otherwise inquires into the background of its users. In addition, You agree that you will not provide yours or request others financial information (for example, credit card, debit card, other payment methods or bank account information), or wire or otherwise send or accept money, to & from other users.
By using the Service, you agree that you will not:
Use the Service for any purpose that is illegal, harmful, or prohibited by this Agreement.
Violate our Community Guidelines, as updated from time to time, and also never use the service to damage Avius.
Spam, solicit money from, or defraud any users. Impersonate any person or entity or post any images of another person without his or her permission.
Bully, stalk, intimidate, assault, harass, mistreat or defame any person.
Post or broadcast any Content that violates or infringes anyone’s rights, including rights of publicity, privacy, copyright, trademark, or other intellectual property or contract right.
Post or broadcast any Content that is hate speech, threatening, sexually explicit, or pornographic, incites violence, or contains nudity or graphic or gratuitous violence.
Post or broadcast any Content that promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual.
You will not solicit login credentials from another user.
Use another user’s account, share an account with another user, or maintain more than one account of one person or business entity.
Create another account if we have already banned or terminated your account unless you have our permission.
Avius reserves the right to investigate and or terminate your account or remove groupcard without a refund of any purchases if you have violated this Agreement misused the Service or behaved in a way that Avius regards as inappropriate or unlawful, including actions or communications that occur on or off the Service.
11. Other users content:
Avius reserves the right to review and remove Content that violates this Agreement, such Content is the sole responsibility of the user who posts it, and Avius cannot guarantee that all Content will comply with this Agreement. If you see Content on the Service that violates this Agreement, please report it via our contacts.
12. Refund & Cancellation Policy:
Avius may offer products and services for purchase by multiple ways of billing or other payment platforms authorized by Avius. You give your consent to auto-renew your in-app purchase or subscriptions unless you end the auto-renew feature from your account, your mobile system, or payment cards.
There are no refunds, all charges for any kind of successful purchases are final & non-refundable or non-transferable, and there are no refunds or credits for cancellation or partially used periods or in the event user accounts or groupcards got banned by the system or got deleted by their respective owners.
Any technical delay or glitch reported on the app during the processing of the request shall not be eligible for claiming a refund. The User agrees that the timelines are approximate, and all essential steps would be taken to adhere to the timelines as displayed.
No refund shall be processed for the reason that incorrect information or data has been provided by the User. The User agrees to be careful while providing any information to the app or website and must re-check the information filled before proceeding with the payment”.
In case the app or Payment gateway’s webpage, linked to the app, is experiencing any server-related issues like ‘slow down’ or ‘failure’ or ‘session timeout’, the User shall, before initiating the second payment, check whether his/her Bank Account has been debited or not. If debited, user should not make a second payment immediately & should contact the bank for the same, If not debited user may proceed with a fresh transaction to make payment.
However, a refund for multiple payments, if any, even after the above precautions against the same order, shall be refunded in full without deduction of the transaction charges within 30 days period since the date of transaction. The app shall only retain the cost of one single order as intended to be placed by the User.
13. Copyright infringement:
If you believe that your work has been copied and posted on the Service in a way that constitutes copyright infringement, please contact us with the following information: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; a description of the copyrighted work that you claim has been infringed; a description of where the material that you claim is infringing is located on the Service (and such description must be reasonably sufficient to enable us to find the alleged infringing material); your contact information, including address, contact number and email address; a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. Avius will terminate the accounts of repeat infringers.
14. Disclaimers:
Avius provides the service “as is” available & to an extent permitted by applicable law, grants no warranties that the service will be uninterrupted, secure, or error-free or any information you obtain on or through the service will be accurate. Any material downloaded or obtained through the use of the service is accessed at your own discretion & risk.
15. Third-party services:
The Service may contain advertisements and promotions offered by third parties and links to other websites or resources. Avius is not responsible for the availability (or lack of availability) of such external websites or resources. If you choose to interact with the third parties made available through our Service, such party’s terms will govern their relationship with you. Avius is not responsible for such third parties’ terms or actions.
16. Limitation of liability:
In no event will Avius, its affiliates, directors, employees, licensors or service providers be liable for any indirect, consequential, exemplary, incidental, special or punitive damages, including, without limitation, loss of profits, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
17. Assurance by You:
You agree, to the extent permitted under applicable law, to assure, defend and hold harmless Avius, our affiliates, and their and our respective directors, officers, agents, and employees from and against any and all complaints, demands, claims, damages, losses, costs, liabilities and expenses, including attorney’s fees, due to, arising out of, or relating in any way to your access to or use of the Service, your Content, or your breach of this Agreement.
18. Entire agreement:
This Agreement, and any terms of services disclosed and agreed to by you if you purchase additional features, products, or services we offer on the Service, contains the entire agreement between you and Avius regarding the use of the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. The failure of the Company to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. You agree that your Avius account is non-transferable and all of your rights to your account and its Content terminate upon your death. No agency, partnership, joint venture, fiduciary, or other special relationship or employment is created as a result of this Agreement and you may not make any representations on behalf of or bind Avius in any manner.
19. Final terms:
These Terms of Services are an agreement between you and Avius Tech Private Limited, a company registered in India. Any account & groupcards or groups created on Avius Ecosystem if violate the above-mentioned Terms of Services, the account and its associated email get terminated or banned from using the service permanently. Avius Ecosystem: Android, iOS, web portal, desktop apps, corporate logos & the trademark are registered property of Avius Tech Private Limited & are developed with great hard work & time for the betterment of Earth. If any individual, group, or company copies work, feature, idea, or steal code from Avius apps or Avius Web portal will attract strict legal consequences.
